Cycle Shelter Terms and Conditions
1- The Council’ means Broxbourne Borough Council.
2- ‘The User’ means a member of the Laura Trott Leisure Centre, or staff of Broxbourne Borough Council, who has signed up to use a cycle shelter located within Broxbourne.
3- ‘Bicycle’ or ‘Bike’ means bicycle which will fit into one cycle parking space in the cycle shelter.
4- ‘Lock Code’ means the code with which Users can open the cycle shelter.
Conditions
1 – Use of the cycle shelter
The cycle shelter is provided by Broxbourne Borough Council to increase the provision of secure, accessible and covered bicycle storage.
2 – Your requirements for a space in a hangar
Users must be a customer of the Laura Trott Leisure Centre or staff of Broxbourne Borough Council.
3 – No other property except bicycles and e-bicycles
No other items, other than the bicycles and e-bicycles may be stored in the cycle shelter. Any other items may be removed by the Council without warning.
4 – 24 Hour access
The shelter is accessible 24 hours a day, 7 days a week, 365 days a year.
5 – User instructions
The user must comply with the User Instructions for the cycle shelter as provided when signing up to use this facility. Users will receive the access code for the shelter’s mechanical code lock when signing up to use this facility.
6 – E-bike charging
This facility is fitted with a double socket outlet which can be used by e-bike users for charging. Users have to bring their own chargers to do so as these are not provided. The charging is free of charge.
7 – Insurance
The Council recommends that users ensure their Bicycle(s) or E-bicycles and check the insurance is applicable to cycle storage within public bicycle storage. Nearly all insurers will consider a bike parked in a cycle shelter as being ‘away from home’. Many policies won’t cover the bike for theft or damage away from home, or may impose restrictions, such as maximum value, and excess payments. If these issues arise with a user’s home insurance, it may be worth removing the bikes from that policy and insuring the bikes separately with cycle-specific insurance.
8 – Risk
All items in the cycle shelter are left entirely at the user’s risk. The Council will not accept responsibility for bicycles, locks or other items that are lost, stolen or damaged if the cycle shelter is broken into or vandalised.
The Council recommends that users secure their bicycle(s) using two different high-quality locks, and that the front wheel and frame of the bicycle, and the rear wheel and frame of the Bicycle are separately locked to the rack when leaving it in the cycle shelter. A poor-quality lock can be easily cut through.
9 – Locks
The Council reserves the right to change user access codes at any time. To obtain a new code users must submit a new webform via the website link or QR displayed.
10 – Damage to the cycle shelter
Users must take all reasonable care when using the cycle shelter and avoid damaging it or any equipment contained within it. If users damage the cycle shelter and/or a third party’s property within it, they are responsible for paying for any cost incurred in rectifying the damage.
11 – Reporting damage
Users of the shelter must report any damage or maintenance issues to the Council at sustainability@broxbourne.gov.uk. These will be assessed and repaired, if necessary, at the earliest possible opportunity.
12 – Removing your bicycle if left in the shelter
It is not permitted for a user to leave a bicycle inside the shelter for more than seven days. Failure to remove a bicycle after seven days will result in the bicycle being removed from the shelter without further notice or warning. Upon removal the bicycle will be safely stored at the Bishops College, Churchgate, Cheshunt, Waltham Cross EN8 9XQ. Users will then have 14 days to collect the bicycle before it becomes the property of the Council. Users should contact the Sustainability team at sustainability@broxbourne.gov.uk to collect their bicycle.
13 – Compensation
Users are not entitled to any compensation of any goods removed or any damage caused to such goods, including bicycles and locks.
